These Terms of Service ("Terms") are a legal agreement between you and eMeals, Inc ("Endurance by Design," "we," "us," or "our") governing your access to and use of the Endurance by Design mobile application, Apple Watch companion app, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you have the authority to enter into these Terms.
Endurance by Design provides AI-assisted, personalized endurance training plans and tools, including plan generation, daily readiness scoring, workout guidance, plan adaptation, and synchronization with compatible devices and apps. The Service relies in part on artificial intelligence and on data from your wearables and connected accounts. Training recommendations are informational and are not a substitute for professional coaching or medical advice (see Section 5). We may add, change, or remove features at any time.
To use most features you must create an account. You agree to provide accurate information and to keep your credentials secure. You are responsible for activity that occurs under your account. Notify us promptly at support@endurancebydesign.com if you suspect unauthorized use.
The Service is offered through paid, auto-renewing subscriptions. The plans available, their prices and billing periods, and any free trial or introductory offer are shown in the app and on the App Store at the time of purchase, and they may change over time. We regularly test different plans, prices, and offers, so the options shown to you may differ from those shown to other users or at other times. Any price change applies only to future billing periods.
Endurance by Design is not a medical device and does not provide medical advice. The Service offers general fitness and training information and is not a substitute for professional medical advice, diagnosis, treatment, or personalized coaching. Endurance training carries inherent risks, including injury.
You agree not to: (a) use the Service for any unlawful purpose; (b) reverse engineer, decompile, or attempt to extract source code, except as permitted by law; (c) interfere with or disrupt the Service or its infrastructure; (d) access the Service through automated means or scrape its content; (e) resell, sublicense, or commercially exploit the Service without our permission; or (f) misuse, overload, or attempt to circumvent any rate limits, security, or usage controls.
The Service integrates with and relies on third-party platforms, including Apple (HealthKit, App Store) and Strava (which also brings in activities recorded on Garmin and other watches), and it uses analytics and advertising providers such as AppsFlyer, Meta, TikTok, Google, and Apple Search Ads to measure and run our marketing. Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for their availability, accuracy, or practices. How we collect, use, and share data, including for advertising and attribution, is described in our Privacy Policy. Connecting or disconnecting optional accounts is your choice.
The Service, including its software, design, text, graphics, logos, and the underlying training and AI methodology, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You retain ownership of the training data and content you provide; you grant us the rights necessary to operate and provide the Service to you.
You may submit content such as reviews, ratings, feedback, survey responses, photos, or messages ("User Content"). You keep ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, display, and distribute it to operate, improve, and promote the Service, including in marketing and advertising. If you would prefer we not feature your User Content, contact us and we will honor reasonable requests where practical. You are responsible for your User Content and represent that you have the rights to share it and that it does not infringe anyone's rights.
From time to time we run promotions, free trials, referral offers, and partnerships with creators and influencers. Specific promotion or referral terms, such as eligibility, rewards, and expiration, may be presented when the offer is made and form part of these Terms. We may track referrals and creator links for attribution, and we may modify or end any promotion at any time. Content created by independent creators reflects their own views, and a testimonial or endorsement is not a guarantee of results.
You may stop using the Service at any time and may delete your account. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED RECOMMENDATIONS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ENDURANCE BY DESIGN OR ITS OWNERS, OFFICERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Endurance by Design and its owners and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute that is not subject to arbitration or small-claims resolution, except where prohibited by applicable law. Nothing in these Terms limits any non-waivable consumer rights you may have in your country of residence.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice within the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
